Thanks for the information guys - I'll be needing to sort my trunk lid out too - has anyone tried the old 350z coin trick to cure the issue?

Got the boot springs replaced under warranty - The replacements seem to be slightly longer than the old ones (is that just because they're newer? only time will tell). Anyway - they work! Give it a few months and colder weather and we'll see if they still work! If they don't, I'll be asking for new boot struts.

Mine hasn't failed to open in one press since changing them.

To answer my own question - now that I've had my boot springs replaced I thought I'd take the old ones apart.

The outer cover pulls off easily and, as you can see from the 2nd photo (showing the coin on its way in), a 1p coin fits perfectly at the end of the spring. If my replacement springs fail to work in cold weather I shall try my new DIY 'extended' springs.

This issue was one of the first reported on the 2009 the first winter season the model was out. We all said,,,geez Nissan did not learn their lesson with the 350Z with same issue. Apparently with the 350Z and now with the first model of 370Z Nissan of Japan does not have as an option the rear deck spoiler, therefore the lighter hatch springs causing stuck hatchs in cold weather. Apparently Japan is not installing these at the dealer as a mfg option when ordering the car. Mine was replaced the first year and I had to video tape the incident happening as it would only happen once in the early morning. They finally replaced it under warranty and now after threee years it's starting to occur again. So the bros 2009 model never had this occur until recently and we found out Nissan has Revised the part 5 times, they are on part # revision E. And the 2009 is no longer covered under warranty. The buggers are running $50. US dollars per spring.

A forum member (US) found that by removing the 2.5 lb weigh in the rear hatch panel will solve the issue. Then there is the coin method already discussed here and abroad. Any-who that is what is happening stateside with this issue.

Out of warranty
Part number is on fifth revision
Part runs $50 USD per spring

I used the '1p coin trick' yesterday (see pics in my earlier post), because the new 'improved' springs that were fitted under warranty earlier in the year are proving to be absolutely useless in this weather and...

...tried it in the frost last night and it works. Boot lid opens first time, even in frosty weather.

So far, it's a quick, easy fix for an annoying problem.

Edit - and it only cost 2p, refundable upon sale of the vehicle.

 I think I'll remove the weight and then fit the pennies if I need to at some point in the future.

^ +1 on the affordable option.

Plus by removing the 2.5 lb weight in the hatch panel is worth at least 3 more horsepower at the wheel.
